Terms of Use

Effective date: June 2, 2026

Last updated: October 22, 2026

This page is available in English only. The English text is the authoritative version of these Terms; no translation of it is offered or binding. This does not limit information or language rights required by applicable law.

Agreement, Ownership and Worldwide Scope

Kapachain is owned by KAPACHAIN F.Z.E. These Terms govern your use of Kapachain with KAPACHAIN F.Z.E, unless a separate written agreement expressly provides otherwise. Kapachain Pty Ltd, a partner of KAPACHAIN F.Z.E, handles operation of the website and related operational support on its behalf.

These Terms apply worldwide to the websites, applications, APIs, demonstrations, support and enabled modules, including free memberships, paid subscriptions, enterprise arrangements, trials and purchased add-ons. Signed-in users must affirmatively accept the current version before accessing gated services, and purchasers must separately confirm acceptance for each add-on purchase. We record the accepted version, text digest and acceptance time. Authentication or continued use alone is not a substitute for required consent. You must have legal capacity and authority to bind any organization you represent. A signed agreement, accepted order or data-processing agreement governs its specific subject matter and prevails over conflicting general terms where it expressly does so. Applicable mandatory rights always remain in force.

Features, Modules and Availability

Depending on your entitlements and enabled configuration, the service may include wallet and transaction investigation; blockchain tracing; graph and ledger analysis; clustering and attribution; cross-chain fund flow and fiat valuation; cases, evidence, notes, collaboration, assignments and review; provenance and verification; reports and exports; STR/SAR preparation; alerts and monitoring; AI assistants and assisted workflows; KYT/AML (Know Your Transaction / anti-money-laundering), sanctions, PEP and adverse-media screening; VASP and jurisdiction intelligence; online research; Travel Rule assessment and records; APIs and integrations; and organization, access, usage and billing administration. KYT/AML concerns transactions and wallet activity, not KYC or eKYC identity verification. Kapachain does not certify an individual's identity, authorize a transaction, act as a financial intermediary, or guarantee compliance with customer-due-diligence or reporting obligations.

This scope describes the activities to which the Terms apply, not a promise that every module, chain, provider, dataset, asset, geography or payment option is available in every plan. Chain capabilities vary by network and operation: a chain may support wallet lookup but not a particular source, graph, token or fund-flow operation, and support on one chain does not imply the same feature or history depth on another. Provider availability, supported assets and event types, pagination, transaction limits and configured graph or tracing depth may differ and may cause results to be partial, stale, unavailable or to omit activity. Review published capability limitations and any result-level coverage warning before relying on an output. An empty result, missing edge or absent finding is not proof that no activity occurred. Beta, preview, demonstration, restricted or unconfigured features may be incomplete or unavailable. Published capability limitations, the applicable offer and your confirmed entitlements determine access. A roadmap or draft catalog is not a purchased entitlement or delivery commitment.

Investigative Outputs and Human Responsibility

Kapachain provides investigative and compliance-support tools. It does not conduct investigations on your behalf, provide legal, investment or tax advice, interpret or enforce regulation, determine your legal obligations, or make compliance or law-enforcement decisions for you. You remain responsible for your lawful purposes, policies, professional judgments and review of all outputs.

Risk scores, clusters, labels, attribution, screening matches and adverse information may be incomplete, outdated or incorrect. An address association, cross-chain link, exchange deposit or USD estimate is not proof of identity, wrongdoing, ownership, recoverability or fiat cash-out. Prices and conversions are estimates dependent on the stated source and time. Blockchain finality, provider coverage and investigative completeness are not guaranteed.

AI-generated answers, narratives and recommendations can contain errors or unsupported inferences. Verify source evidence and do not use outputs as the sole basis for decisions that materially affect a person's rights. Case records, reports and STR/SAR preparation materials are drafts requiring your review, not regulatory filings, legal determinations or guaranteed official filing schemas. You decide whether, where and when to file. Travel Rule assessment does not establish compliance or prove transmission or receipt; external delivery remains disabled unless expressly enabled and verified for your service.

Accounts, Organizations and Acceptable Use

Keep account information accurate and protect credentials, API access and devices. Organization administrators manage authorized members, seats, sharing and roles within the service's controls. Access may depend on identity verification, membership, organization policy and device-session restrictions. Do not evade limits, share credentials contrary to your license, bypass access controls or represent another person's approval or signature as your own.

Use the service only for lawful, authorized purposes. Do not engage in unlawful surveillance, harassment, discrimination, fraud, unauthorized access, malicious code, infringement or attempts to expose protected data. Do not upload private keys, seed phrases or unnecessary sensitive information. Obtain the rights, notices and permissions necessary for submitted records, searches, monitoring and third-party integrations. You are responsible for customer instructions, lawful sharing and any onward use of exports.

Subscriptions, Seats, Credits and Add-ons

Free, Pro, Team, Compliance and Enterprise plans provide the limits and features stated in the applicable offer and confirmed account entitlements. Subscription prices, currencies, billing intervals, included usage, seats and applicable taxes must be reviewed in the checkout or accepted order. Subscription charges and any automatic renewal apply only as disclosed and authorized in that purchase flow or agreement. No undisclosed recurring charge is authorized by these Terms.

Prices and taxes. Unless your accepted order or signed agreement says otherwise, all prices shown on the website, in the application and in quotations are stated inclusive of all applicable taxes, such as GST, VAT and sales tax. The tax included in a price depends on your location and tax status and is shown at checkout and on your invoice; where no tax applies to your purchase, the amount payable is the price shown. Nothing in this paragraph excludes or limits rights that cannot lawfully be excluded.

Investigation or AI credits, additional seats, KYT/AML request bundles and other add-ons may be separately offered. Their included quantity, validity, consumption, expiry and payment terms are those disclosed for the particular purchase. Subscription and add-on prices are configured independently for each supported currency, not derived by foreign-exchange conversion. An unconfigured currency requires a quotation; changing the currency selector does not authorize a different-currency charge. Subscription cancellation does not by itself refund consumed usage or extend expiring entitlements. Asset valuations and other illustrative conversions are not payment quotations. A bank-transfer enquiry is not proof of payment or activation; access and credits depend on confirmed payment and applicable provisioning.

Add-on packages and credits. Add-ons are paid once, in full, not in monthly instalments and not automatically renewed. Unless your accepted order or signed agreement says otherwise: (a) AI-action and investigation-credit packages are valid for up to 12 months from purchase. When paid subscription access ends, including failed renewal or explicit cancellation, unused purchased credits are preserved for a 14-day renewal grace period, but paid tools and spending those credits are suspended. Confirmed renewal within those 14 days restores only credits that have not reached their own expiry. At the grace deadline, unspent old credits are forfeited and later renewal cannot restore them. Grace never extends a package's own expiry or repeats because a payment retry or cancellation event is replayed; (b) KYT/AML bundles are valid for 12 months from purchase independently of any subscription, so subscription cancellation does not forfeit them; (c) extra seat packs are time-limited, prorated to the remainder of the subscription term in which they are bought, never more than 12 months. Their own validity ends with that term; they do not grant free seats during grace or in the next term and must be purchased again after renewal; (d) buying another credit package of the same type carries forward only still-valid unused credits of that type and re-dates that pool to 12 months from the new purchase; expired or forfeited credits are not restored; (e) monthly AI and investigation allowances are used first, then purchased credits. Unused included monthly credits do not roll over; the monthly reset does not reset purchased balances. Included annual KYT/AML allowances are separate; and (f) the read-only export period below is independent and does not extend credit validity or paid access. Quantities, tax-inclusive prices and expiry conditions are disclosed for purchase. Forfeiture and non-refund provisions are subject to mandatory consumer guarantees, withdrawal rights and other remedies required by law; accepting these Terms is not itself a waiver of such rights.

Trials, pilots, promotional grants and previews are subject to their stated eligibility, duration and limits. They do not automatically become paid subscriptions without the required disclosed authorization. Draft catalog or pilot designs, including proposed grace periods, are not promised benefits unless included in an enabled offer or signed agreement.

AI and Investigation Credit Use

AI credits are counted per admitted metered AI request: each such request uses 1 AI credit, not one credit per token, internal model step or tool call within that request. Examples include an assistant message, an AI investigation request, an investigator brief, generation of a new AI summary and a separately requested AI report. A workflow that submits separate metered AI requests can therefore use more than 1 AI credit. Reopening an unchanged cached AI summary uses 0 AI credits; requesting a new summary is a separate metered AI request.

Graph navigation, building a graph and selecting or increasing graph depth alone use 0 AI credits. Underlying data requests can still use Investigation credits. Investigation credits are counted per metered request: a trace request uses 1 Investigation credit, a graph request uses 2 Investigation credits and a fundFlow (fund-flow) request uses 20 Investigation credits. These are not charges per displayed node or hop. A depth expansion or frontier fan-out can submit multiple metered requests, so one graph action can use more than one request's credits. For example, three metered graph requests use 6 Investigation credits, regardless of how many nodes they display. Any displayed credit estimate is an estimate of the requests expected, not the actual server debit; actual consumption is determined by the metered requests admitted and processed by the server under the applicable route's rules.

An optional fund-flow analysis can use Investigation credits separately from an AI request in the same workflow; enabling it does not make the fundFlow request part of the 1 AI credit charge. A KYT/AML AI analysis uses 1 AI credit for its admitted metered AI request and requires a separate KYT/AML entitlement; AI credits do not replace KYT/AML request allowances or bundles. Feature availability and access remain subject to your plan and enabled entitlements.

Cache reuse, duplicate-request handling (idempotency) and credit refunds depend on the particular route and request. A cache hit or retry is not universally free, and an error, incomplete result or failed request does not by itself mean that no credits were used or that all credits will be refunded. Any applicable credit release or refund follows that route's metering rules, subject to mandatory rights under these Terms and applicable law. Included monthly AI and Investigation allowances are used first, then valid purchased credits; the existing expiry, renewal grace and cancellation provisions above and below remain applicable.

Cancellation, Changes, Payments and Refunds

Use the available subscription-management or payment-provider controls, or contact support@kapachain.com, to request cancellation or a plan change. Explicit cancellation stops future subscription billing at the end of your current paid billing cycle, not on the day you request it. For monthly-billed subscriptions, paid access continues until the end of the current paid monthly cycle and no further monthly instalments are charged after that cycle; cancellation does not require you to pay the remaining months of an annual entitlement year. For subscriptions paid annually upfront, paid access continues until the end of the paid annual period and no further annual renewal is charged. We do not provide a partial-period or unused-time refund for voluntary cancellation, except where mandatory law or your accepted order or signed agreement requires otherwise.

The additional 14-day renewal grace period starts only when that paid billing cycle ends, not when cancellation is requested. During grace there is no subscription renewal charge unless you authorize renewal, paid tools and spending purchased AI/investigation credits are suspended, and only unexpired purchased AI/investigation credits are preserved. Confirmed renewal before the grace deadline restores those still-valid credits; otherwise they are forfeited at the deadline. Grace is not free paid access and does not extend a pack's own expiry, seat validity or the separate read-only export period. For example, if your monthly paid access ends on 31 October, requesting cancellation earlier in October keeps access through 31 October and starts the 14-day grace period at that paid-cycle end. Changes can affect limits, seats, premium features and access to retained records; export authorized information before access ends where that function remains available.

Unless otherwise agreed, fees are non-refundable except where required by law or stated in the applicable offer or commercial agreement. Mandatory withdrawal, cancellation, refund and consumer-guarantee rights are not excluded, including where advance information or consent is legally required. Failed payments, chargebacks or expired entitlements may restrict paid access subject to applicable law and contractual notice requirements. Material price or renewal changes require the notices and any consent mandated by law or your agreement.

Ending a subscription or account does not by itself delete cases, evidence, audit records or billing history. Retention, legal holds and deletion review remain governed by the Privacy Policy, applicable agreement and law. No premium-data archive or indefinite retrieval is promised, and this paragraph does not extend any retention or access period beyond the export period in the section on Subscription Expiry, Data Retention and Export, which applies once a paid term ends.

Subscription Expiry, Data Retention and Export

A history-retention period stated for a plan (for example 90 days, 365 days, 7 years or 10 years) is the longest time that saved investigation history and case records can remain accessible in the service while a paid subscription for that plan is active and in good standing. It is a service limit, not an archive, escrow, records-management or regulated record-keeping service, and not a promise that records are kept for that long or deleted when it ends. The Free plan does not include saved investigation history: we do not retain history for Free accounts, and anything your browser keeps in local storage stays on your own device, is not retained, backed up or recoverable by us, and may be lost at any time.

If a paid subscription is not renewed, is cancelled, lapses for non-payment or is otherwise ended, paid entitlements, limits and seats end when the paid term ends and the account reverts to a Free account (or is suspended or closed, as applicable). For a limited export period after the paid term ends we will make your saved cases, case records and history available to you in read-only form so that you can review and export them: 30 days for Pro and Team plans and 90 days for Compliance and Enterprise plans, unless your accepted order or signed agreement states otherwise. The Free plan has no export period. During the export period you cannot create or change records, run paid features or use the plan's capacity, and Free-plan limits apply. The export period is not an extension of your subscription, runs from the end of the paid term, and is not extended by a missed reminder, a support request or a dispute. Subscribing again ends the export period and gives you the plan you buy, but does not guarantee that records which have been deleted can be restored.

When the export period ends, or immediately for a Free account, we have no obligation to keep your records, to keep them accessible or to restore them, and we may archive, de-identify or delete them, subject to this section, any legal hold and applicable mandatory law. A multi-year retention period advertised for a Compliance or Enterprise plan (for example 7 or 10 years) applies only while that plan is active; it does not oblige us to keep records for the remainder of that period after the subscription ends. You are solely responsible for exporting and keeping your own copies of every case file, evidence item, audit trail, report and filing you need to meet your own regulatory, audit, litigation or record-keeping obligations (including anti-money-laundering record-keeping rules, which differ by country and are your obligations, not ours), and for confirming that you are lawfully permitted to hold what you export: case material can include restricted suspicious-matter content. Kapachain is not a regulated records custodian and does not undertake to keep your compliance records for you.

Retained and exported records show information as it was when captured. We do not warrant that retained records, history, scores, labels, attributions, graphs, reports or exports are accurate, complete, current, error-free or fit for any purpose, or that they will remain available or readable in a particular form; the disclaimers in these Terms apply to them in full, and you must verify them before relying on them. Nothing in this section limits rights that cannot lawfully be excluded, including the Australian Consumer Law consumer guarantees. Retention, post-termination access, export assistance, archive or deletion terms that differ from this section apply only if stated in a signed agreement or accepted order, and may carry additional fees. We may keep records that we need for security, fraud prevention, dispute resolution, billing, audit integrity or legal compliance, including audit history and payment records, and we handle records under a legal hold as the hold and applicable law require. Keeping such records does not mean they remain available to you. Retention and deletion requests are handled as described in the Privacy Policy. We may, but are not required to, send expiry or renewal reminders to the account or organization administrator; a missed reminder does not extend any period.

Customer Records, Intellectual Property and Confidentiality

You or the appropriate rights holder retain rights in customer-submitted records. You grant the permissions needed to host, process, transmit and display them to provide the requested service, enforce access and maintain lawful security/audit records, subject to applicable agreements and the Privacy Policy. This does not transfer ownership of your case files to KAPACHAIN F.Z.E or Kapachain Pty Ltd.

KAPACHAIN F.Z.E and applicable licensors retain rights in the platform, software, branding and supplied datasets. You receive only the limited access and use rights permitted by your subscription or agreement. Do not resell access or redistribute licensed datasets, provider material or other protected content without permission. Public sources and generated output do not remove third-party rights. Protect confidential records and only share or export them to authorized recipients; third-party copies may not remain under Kapachain's controls.

Third Parties, APIs and Service Changes

Blockchain networks, data sources, AI providers, identity systems, payment processors and integrations have their own availability, limits and terms. Third-party links are not endorsements. You are responsible for authorized use of your integrations and credentials. APIs and automated activity remain subject to permission, rate, usage and security controls; do not bypass metering or treat temporary availability as a permanent entitlement.

Features may change or be interrupted for maintenance, security, provider changes or legal requirements. Any agreed service levels and support commitments are those in your applicable agreement, not a general guarantee of uninterrupted availability. We may restrict, suspend or terminate access for abuse, security threats, nonpayment, legal requirements or material breach, subject to applicable notice and remedy obligations. This does not authorize ignoring paid contractual commitments or mandatory rights.

Global Use, Trade Restrictions and Local Rights

Worldwide scope does not authorize use where the service, data access, payment or proposed investigation is prohibited. You and Kapachain must comply with applicable sanctions, export controls, privacy, consumer and other mandatory laws relevant to the activity. Geographic restrictions and data-provider licensing can limit access. Do not use the service to circumvent those restrictions. Availability of a country or currency selector is not a representation of regulatory authorization or local data residency.

Mandatory protections prevail wherever applicable, including Australian Consumer Law guarantees and unfair-contract-term protections, including for eligible small businesses; EU/EEA and UK consumer, withdrawal, unfair-term and data-protection rights; UAE consumer and applicable federal or free-zone privacy requirements; US federal and state consumer and privacy law; Canadian federal and provincial consumer and privacy law; Japan's consumer-contract and APPI protections; and South Korea's consumer and PIPA protections. All other supported jurisdictions retain their mandatory local rights. No clause removes a non-excludable remedy, local complaint route, regulator right or court jurisdiction. This is not a claim of regulatory approval, licensing or universal compliance. A business account label alone does not displace protections that legally apply to the customer.

Customers determine their lawful basis, notices, permissions, retention and international-transfer requirements before submitting investigation data, especially criminal-allegation or sensitive information. Where required, an appropriate data-processing agreement and lawful transfer safeguards must be in place. Do not make solely automated decisions with legal or similarly significant effects using Kapachain scores or AI outputs without the lawful basis, safeguards and meaningful human review required by applicable law. A screening result does not replace identity verification, regulatory judgment or reporting to the competent authority.

Disclaimers, Warranties and Liability

THE SERVICE, AND ALL INFORMATION, DATA, SCORES, LABELS, ATTRIBUTIONS, GRAPHS, REPORTS, AI OUTPUTS AND OTHER CONTENT PROVIDED THROUGH IT, ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. To the maximum extent permitted by law, KAPACHAIN F.Z.E, Kapachain Pty Ltd and their licensors and data providers disclaim all warranties, representations and conditions of any kind, whether express, implied, statutory or otherwise, including any warranty of accuracy, completeness, reliability, currency, timeliness, availability, merchantability, satisfactory quality, fitness for a particular purpose, title or non-infringement, and any warranty arising from course of dealing or usage of trade.

We do not warrant that the service, or any information provided through it, will be accurate, complete, error-free, uninterrupted, secure or free of harmful components, that defects will be corrected, or that the service or its information will meet your requirements or expectations, including any legal, regulatory or compliance requirement. Blockchain data, third-party datasets, attributions, risk indicators, screening results, valuations, AI-generated content and other outputs come from sources we do not control and may be incomplete, delayed, mistaken or changed without notice. The absence of a result, flag or alert is not evidence that an address, transaction or entity is lawful or low-risk, and the presence of one is not evidence of wrongdoing.

You are solely responsible for independently verifying information before relying on it, and for every decision, report, filing, freeze, account action or other step you take using the service. We are not responsible for the accuracy, completeness or consequences of any data, score, label, attribution or output, whether it originates from us, from a blockchain or from a third-party provider, or for loss arising from reliance on it or from errors, omissions, delays or interruptions in it. Nothing the service produces is legal, regulatory, investment or tax advice, or a determination of any person's conduct.

To the maximum extent permitted by law, we and our licensors and providers are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, business, data, goodwill or opportunity, arising from or related to the service or these Terms, however caused and even if advised of the possibility. Our total aggregate liability for all claims relating to the service or these Terms is limited to the fees you paid for the service in the twelve months before the event giving rise to the claim or, for a service provided free of charge, the lowest amount applicable law allows. A separately signed agreement may allocate liability differently.

Nothing in these Terms excludes or limits liability or remedies that cannot lawfully be excluded or limited, including mandatory consumer guarantees (such as under the Australian Consumer Law, where, to the extent the law permits, our liability for breach of a non-excludable guarantee is limited to supplying the service again or paying the cost of having it supplied again), or liability for fraud, wilful misconduct, or death or personal injury caused by negligence. An unenforceable part of this section applies to the maximum extent lawful.

Governing Law, Disputes and Contact

These Terms and any dispute or claim arising out of or relating to Kapachain, the website or its operation are governed by the laws of the United Arab Emirates (UAE), subject to mandatory laws and statutory rights that cannot lawfully be excluded. Contact KAPACHAIN F.Z.E through support@kapachain.com to seek resolution; Kapachain Pty Ltd may handle operational correspondence on its behalf. Nothing in these Terms prevents a complaint to a competent authority or limits mandatory local court, consumer or privacy rights. No exclusive court or arbitration venue is imposed by this clause.

Updates and Continuing Obligations

Each revision has a new version and text digest and requires signed-in users to affirmatively accept again before further gated use; each add-on purchase also requires confirmation of the then-current version. We display the current text and last-updated date at this URL and in the legal popup. Material changes affecting existing paid rights require reasonable advance notice and any legally required consent, except where an urgent legal or security requirement justifies a shorter period. A new version does not retroactively change the price, validity or financial terms of a completed purchase without a lawful basis and any required agreement. If you cannot accept a material change, contact support@kapachain.com about cancellation and any applicable remedy; mandatory refund and withdrawal rights remain available. Continued use alone does not replace affirmative consent. Obligations relating to lawful retained records, confidentiality, intellectual property, payment and disputes survive only to the extent applicable. Unenforceable terms do not remove remaining lawful provisions.
